7/6/13 at 9:01 p.m., Troy David MacCubbin (age 41) was driving in the area of Cabrillo Boulevard and Bath Street when he hit two pedestrians walking in a marked crosswalk, causing injuries to both. Police, firefighters, and paramedics responded to contact the injured parties and to investigate the collision. Officer Nelson contacted MacCubbin and became concerned that alcohol was a factor in the collision after he noticed that MacCubbin smelled of alcohol and was displaying signs of intoxication. MacCubbin initially stated that he had not consumed any alcohol and that he was driving slowly, looking for a hotel, when the collision occurred. Officer Nelson conducted a DUI investigation and determined that MacCubbin was too intoxicated to safely operate a motor vehicle. MacCubbin was placed under arrest for DUI and he chose to provide a blood sample which registered his BAC at .12. MacCubbin was booked into County Jail for DUI causing injury with a bail amount of $100,000.00.
